Did you know that in 1998, the MA Dept. of Public Safety adopted OSHA's standard for governing Power Industrial Trucks in its entirety? And then in 2000, they issued a policy to enforce these forklift standards as law? Is your company compliant with ALL of the new statutes? Are you breaking the law?

The Interpretive Policy Statement reads:

This policy statement is intended to clarify the applicability of the Massachusetts statute and regulations governing certain hoisting machinery, M.G.L ch. 146, § 53 et. Seq, and regulations promulgated there under and administered by the Department of Public Safety, 520 CMR 6.00, to industrial, commercial, and warehouse lifting and hoisting equipment.

What does that mean? Owners must have their company policies up-to-date and compliant. Just doing some classroom training is no longer acceptable. Violators of the standards can be fined thousands for each violation and receive a jail sentence to boot!

In 2004, noncompliant companies paid millions in fines for violations of OSHA standards. A company in Massachusetts paid over $114,000 in fines for forklift safety violations alone! With the new law, every company must be 100% compliant with all provisions of OSHA Standard 1910.178 and with 520 CMR 6.00!
